Terms & Conditions

The rules and agreements that govern your access to and use of SwiftVision AI's website, platform, and enterprise computer vision services.

Summary: These Terms & Conditions govern your use of SwiftVision AI's website, demo requests, and enterprise computer vision platform. Enterprise deployments are additionally governed by a separate Enterprise Agreement and Data Processing Agreement (DPA). By using our Services, you agree to these Terms.

Section 01

Acceptance of Terms

These Terms & Conditions ("Terms") form a binding agreement between you ("you," "your," or "User") and SwiftVision AI ("SwiftVision," "we," "us," or "our") governing your access to and use of our website (swiftvision.ai), enterprise platform, APIs, demos, and related services (collectively, the "Services").

By accessing or using our Services, requesting a demo, or otherwise interacting with SwiftVision AI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

Enterprise Clients

If your organization has entered into a separate Enterprise Agreement with SwiftVision AI, the terms of that agreement will govern your enterprise deployment in the event of any conflict with these Terms. These Terms continue to apply to your general use of our website and communications.

Section 02

Who We Are

SwiftVision AI is an enterprise computer vision technology company headquartered at 1500 North Grant Street, Denver, Colorado 80203, United States. We build and operate scalable AI vision systems for enterprise clients across multiple industries.

Our platform serves seven core verticals: Sports Analytics, Sports & Fitness AI, Retail Intelligence, Surveillance & Security AI, Industrial Monitoring, Healthcare Vision AI, and AI Agents & Automation. References in these Terms to "Services" include our website, demos, live showcases, case studies, dashboards, APIs, and AI platforms across all of these verticals.

Section 03

Use of Our Services

You may use our Services only for lawful purposes and in accordance with these Terms. You agree that you will not use our Services in any way that could:

  • Damage, disable, overburden, or impair our systems, servers, or networks
  • Interfere with any other party's use or enjoyment of the Services
  • Attempt to gain unauthorized access to any part of the Services, other accounts, or connected systems
  • Violate any applicable local, national, or international law or regulation
  • Misrepresent your identity, affiliation, or authority to act on behalf of an organization

We reserve the right to restrict, suspend, or terminate access to the Services for any user who violates these Terms.

Section 04

Accounts & Enterprise Access

Access to our enterprise platform, dashboards, and APIs is provided to authorized users of enterprise clients under a valid Enterprise Agreement. If you are provided with account credentials, API keys, or other access mechanisms, you agree to:

  1. Keep all credentials confidential and not share them with unauthorized individuals
  2. Notify us promptly of any suspected unauthorized access to or use of your account
  3. Be responsible for all activity that occurs under your account credentials
  4. Use the platform only within the scope, usage limits, and configuration agreed with your organization

SwiftVision AI reserves the right to suspend account access where we reasonably believe credentials have been compromised or are being used in violation of these Terms.

Section 05

Enterprise Demos & Sales

Requests for demos, consultations, webinars, or enterprise deployments — whether submitted through our website, Calendly, email, or otherwise — do not by themselves constitute a binding agreement for paid services.

  • A binding commercial relationship is formed only upon execution of a separate written Enterprise Agreement signed by both parties
  • Pricing, features, timelines, and capabilities discussed or demonstrated during a demo or sales conversation are for illustrative purposes and are subject to change
  • Live demo footage and showcase results reflect specific production deployments and may not represent results achievable in every environment, camera setup, or use case

Scheduling Tools

Demo bookings made through Calendly or similar scheduling tools are subject to the terms and privacy practices of those third-party platforms in addition to these Terms.

Section 06

AI Outputs & Accuracy

SwiftVision AI's platforms use computer vision, machine learning, and pose-estimation models to generate detections, analytics, alerts, scores, and reports (collectively, "AI Outputs"). While we design our systems for high accuracy and reliability, you acknowledge and agree that:

  • AI Outputs are generated by automated systems and may contain errors, omissions, or inaccuracies
  • AI Outputs should not be relied upon as the sole basis for critical safety, medical, legal, employment, disciplinary, or operational decisions without independent human verification
  • Performance metrics shown in demos and case studies (e.g., detection accuracy, time savings, incident reductions) reflect specific deployments and are not guarantees of performance in your environment
  • For Healthcare AI applications, AI Outputs are decision-support tools only and are not a substitute for professional medical judgment or diagnosis by a licensed clinician
  • For Surveillance and Industrial AI applications, AI Outputs are intended to support — not replace — human security and safety oversight

Important Notice

SwiftVision AI's AI Outputs are tools to assist human decision-makers. Final responsibility for decisions made using our Services — including safety, medical, security, and operational decisions — rests with the user and their organization.

Section 07

Intellectual Property

All content available through our Services — including text, graphics, logos, software, models, dashboards, platform designs, demo footage, and case study materials — is the property of SwiftVision AI or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

Except as expressly permitted under a written Enterprise Agreement, you may not:

  • Copy, reproduce, distribute, or publicly display any part of our Services or content
  • Modify, reverse engineer, decompile, or create derivative works based on our software, models, or platform
  • Use SwiftVision AI's name, logo, or trademarks without prior written consent
  • Extract or replicate our underlying AI models, datasets, or training methodologies

Any feedback, suggestions, or ideas you provide to us regarding our Services may be used by SwiftVision AI without restriction or compensation.

Section 08

Acceptable Use

When using our Services, you agree not to:

  • Deploy our computer vision platform for surveillance of individuals without appropriate legal basis, notices, and consents required under applicable privacy laws
  • Use facial recognition capabilities without explicit written authorization from SwiftVision AI, where applicable, and full compliance with local biometric data laws
  • Use the Services to discriminate against, harass, or unlawfully monitor employees, customers, patients, or any individuals
  • Upload or process video, imaging, or data that you do not have the legal right to use
  • Use the Services in any manner that could cause harm to minors, including unauthorized monitoring of children outside of properly consented deployments (e.g., youth sports academies)
  • Probe, scan, or test the vulnerability of our systems without prior written authorization

Violation of this section may result in immediate suspension or termination of access, in addition to any other remedies available to SwiftVision AI under law or contract.

Section 09

Fees & Payment

Use of our website, demo bookings, and informational content is provided free of charge. Fees for enterprise platform access, deployments, support, and licensing are set out in the applicable Enterprise Agreement or order form agreed between SwiftVision AI and the client.

  • All fees are exclusive of applicable taxes unless stated otherwise
  • Payment terms, invoicing schedules, and currencies are specified in the relevant Enterprise Agreement
  • Late payments may result in suspension of access to the platform until amounts due are settled, subject to the terms of the Enterprise Agreement
Section 10

Confidentiality

In the course of demos, sales discussions, and enterprise deployments, both parties may share confidential information, including business plans, pricing, technical architecture, footage, and platform configurations.

  • Each party agrees to use the other party's confidential information only for purposes of evaluating or performing the Services
  • Confidential information must not be disclosed to third parties without prior written consent, except as required by law
  • Detailed confidentiality obligations for enterprise deployments are set out in the applicable Enterprise Agreement or a separate Non-Disclosure Agreement (NDA)
Section 11

Disclaimers

To the maximum extent permitted by applicable law, our Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

SwiftVision AI does not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • AI detections, alerts, or analytics will be 100% accurate under all conditions, camera setups, or lighting environments
  • Results, time savings, or incident reductions referenced in case studies and demos will be replicated in your specific deployment

Specific service-level commitments (such as uptime SLAs) apply only where expressly stated in a written Enterprise Agreement.

Section 12

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SwiftVision AI, its officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your access to or use of, or inability to access or use, the Services — even if we have been advised of the possibility of such damages.

Where liability cannot be excluded under applicable law, SwiftVision AI's total aggregate liability arising out of or relating to these Terms or the Services shall be limited to the amount paid by you (if any) for access to the Services in the twelve (12) months preceding the event giving rise to the claim, except where a higher cap is expressly agreed in an Enterprise Agreement.

Section 13

Indemnification

You agree to indemnify, defend, and hold harmless SwiftVision AI and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Services
  • Your violation of these Terms or any applicable law
  • Video, footage, or data you upload, process, or provide to us without proper rights or consents
  • Your deployment of our Services in a manner that violates the privacy or other rights of third parties, including employees, customers, patients, or minors
Section 14

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, acted unlawfully, or posed a risk to SwiftVision AI, other users, or third parties.

For enterprise clients, termination of platform access is governed by the termination provisions of the applicable Enterprise Agreement. Upon termination, your right to use the Services will immediately cease, though provisions relating to intellectual property, confidentiality, indemnification, and limitation of liability shall survive.

Section 15

Third-Party Links & Services

Our website and materials may contain links to third-party websites, services, or tools, such as Calendly for demo booking, LinkedIn, cloud partner portals (AWS, Azure), and other integrations. These Terms do not govern your use of such third-party services.

We have no control over, and assume no responsibility for, the content, terms, privacy policies, or practices of any third-party websites or services. Your interactions with such third parties are solely between you and them.

Section 16

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the state and federal courts located in Denver, Colorado, and the parties consent to personal jurisdiction therein, except where an Enterprise Agreement specifies an alternative dispute resolution mechanism (such as arbitration).

Section 17

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Post a notice on our website where required
  • For enterprise clients, provide notice through account communications as set out in the applicable Enterprise Agreement

Your continued use of the Services after any such changes take effect constitutes your acceptance of the revised Terms.
